GLO Terms & Conditions

These GLO Terms & Conditions ("Terms") govern your purchase of tickets and participation in any GLO tour or event operated by MeshMap Labs Inc. d/b/a "GLO" ("GLO," "we," "us," or "our"). GLO provides location-based immersive experiences, including guided augmented reality (AR) tours and related services (the "GLO Services" or "GLO Experience").

These Terms supplement and incorporate by reference the MeshMap Terms of Service and Privacy Policy, which also apply to your use of the GLO Services. The MeshMap Terms of Service contain a mandatory arbitration provision and class action waiver that apply to disputes arising out of or relating to any Services, including GLO Services.

In the event of a conflict between these Terms and the MeshMap Terms of Service, these Terms will control with respect to GLO Services.

By purchasing a ticket, registering for, or participating in a GLO Experience, you agree to these Terms and you expressly acknowledge that you have read and agree to those arbitration provisions.

1. Age Requirements

Participants must be 13 years of age or older. Participants under 18 must be accompanied at all times by a parent, legal guardian, or designated adult authorized by a parent or legal guardian and identified in the minor's Participation Waiver.

2. Participation Waiver Required

All participants must sign a separate Participation, Release and Waiver Agreement ("Participation Agreement") prior to beginning any GLO Experience. Participants under 18 must have a parent or legal guardian sign on their behalf.

Participation in certain GLO Experience is conditioned on acceptance of the Participation Agreement, and failure to complete such agreement may result in denial of participation without refund.

3. Nature of Experience & Assumption of Risk

GLO Experiences are guided walking experiences conducted in public or privately-owned urban environments not controlled by GLO. Tours may involve walking approximately five city blocks on sidewalks with minor elevation changes. Participants may use AR devices provided by GLO.

Participation involves inherent risks, including but not limited to trips, falls, uneven surfaces, traffic exposure, weather conditions, interactions with third parties, and temporary dizziness, distraction, or disorientation associated with AR or immersive content. You agree to remain aware of your surroundings at all times, follow all instructions provided by GLO staff, comply with applicable laws, and refrain from running, unsafe behavior, or misuse of devices.

By participating, you voluntarily assume all risks associated with the Experience to the fullest extent permitted by law.

4. Participant-Created Artwork & User Generated Content

During a GLO Experience, participants may create digital visual works including drawings, digital overlays, or other creative expressions ("Participant Artwork"). The foregoing license is intended to supplement and be consistent with any rights granted in a Participation Agreement, and to the extent of any conflict, the broader rights granted to GLO shall control to the maximum extent permitted by law.

Ownership and License Grant

You retain ownership of your original Participant Artwork. However, by participating, you grant GLO a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable license to use, reproduce, photograph, digitize, modify, adapt, display, distribute, publicly perform, create derivative works from, and commercially exploit Participant Artwork in any media now known or later developed.

This license includes the right to use Participant Artwork created during Experiences in both digital and physical formats, including public displays, installations, events, advertising, social media, and merchandise.

Waiver of Moral Rights

To the maximum extent permitted by law, you waive any moral rights, rights of attribution, integrity, or similar rights in Participant Artwork.

Minor Artwork Consent

If Participant Artwork is created by a minor, the parent or guardian grants the above license and waivers on behalf of the minor pursuant to the Participation Agreement.

Commercial Exploitation & Merchandising

GLO may incorporate Participant Artwork into merchandise including apparel, prints, posters, digital collectibles, and other products. You acknowledge that you are not entitled to compensation, royalties, approval rights, credit, or accounting unless expressly agreed in writing. GLO has no obligation to use or commercialize any Participant Artwork.

Participant Representations & Warranties

You represent and warrant that your Participant Artwork is original, does not infringe third-party rights, does not contain unlawful content, and that you have authority to grant these rights.

UGC Moderation

GLO reserves the right, but not the obligation, to monitor, review, remove, or decline to use any Participant Artwork in its sole discretion. If GLO receives notice of alleged infringement, GLO may remove or disable access pending review.

5. Photography and Likeness

GLO may capture photographs, video, or other media during GLO Experiences. Your rights and GLO's rights to use your name, likeness, voice, and participation are governed by the Participation Agreement. By participating, you acknowledge that such materials may be captured and used in connection with the GLO Services.

6. Participant Conduct; Removal

GLO reserves the right to remove any participant from a GLO Experience without refund if, in GLO's reasonable judgment, the participant engages in unsafe, disruptive, or unlawful behavior, fails to follow instructions, or interferes with the enjoyment of the GLO Experience by others.

7. Third-Party Platforms and Locations

GLO Services may be booked using third-party platforms and may take place in third-party locations. GLO is not responsible for the acts, omissions, policies, or conditions of such third parties, including payment processing, booking errors, or premises conditions.

8. Cancellation & Refund Policy

Full refund if canceled at least 48 hours prior to tour start. No refunds within 48 hours or for no-shows. If GLO cancels due to safety, weather, or force majeure, guests may reschedule or receive a full refund.

9. Limitation of Liability

To the maximum extent permitted by law, GLO shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the GLO Services.

GLO's total cumulative liability arising out of or related to the GLO Services shall not exceed the amount paid by you for the applicable GLO Service. To the extent of any conflict with the MeshMap Terms of Service, this Section 9 governs with respect to GLO Services.

Nothing in these Terms limits liability to the extent such limitation is prohibited by applicable law.

6. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles, with respect to GLO Services.
